Drug Production & Cannabis Cultivation Defence

Production and cultivation cases can range from alleged commercial operations to disputes about knowledge, premises and role. The defence should separate actual participation, indirect involvement, ownership or occupation of premises and what the defendant knew.

KEY ANSWER

The position in brief

Section 4(2) Misuse of Drugs Act 1971 covers production and being concerned in production. Section 6 separately addresses cultivation of cannabis.

Current CPS guidance distinguishes actual participation from indirect involvement. A person said to be concerned in production must be linked to the production process and shown to have the required knowledge.

Legal issues

Issues can include whether production occurred, the defendant’s role, knowledge, control of premises, classification and quantity, section 28, and whether the appropriate charge is production, cultivation or another offence.

Production can also have POCA consequences because it is treated as a lifestyle offence for confiscation purposes.

Evidence that matters

Evidence may include search photographs, grow equipment, utility records, tenancy/ownership documents, fingerprints/DNA, phones, financial records, CCTV and forensic drug analysis.

Reasonable lines of enquiry

Enquiries may include proving occupancy and access, forensic attribution, utility usage, financial links, phone ownership, alternative explanations for presence at premises and whether the defendant actually participated in production.

What happens next

Production and cultivation are generally either-way offences, with serious cases proceeding to the Crown Court. Organised production may also generate conspiracy, trafficking or POCA proceedings.

Immediate steps

Preserve tenancy, employment, utility and financial records showing your relationship to the premises. Record who had keys or access and the period of any occupation.

What should you send us?

FREQUENTLY ASKED QUESTIONS

Questions about this issue

Is owning or renting a property enough to prove drug production?

No. Ownership or occupation may be evidence, but the prosecution still has to prove the elements of the offence and the defendant’s role and knowledge.

What is the difference between production and cultivation?

Production under section 4 is broader; cultivation of cannabis has a separate statutory offence under section 6. CPS guidance explains when production may be the more appropriate charge.

Can POCA follow a production conviction?

Yes. Production can trigger confiscation issues and should be considered alongside the underlying criminal case.
